Jesse Wilson is charged with 2 Felony counts of attempted murder, and five counts of assault with a deadly weapon.
He brought a gun with him when he stepped out (just a few feet) of his apt to observe what was causing all the shouting and loud noise right outside close to midnight. The 5 loud and aggressive people 2 men and 3 women had just seconds earlier confronted (terrorized) another neighbor and ordered him back to his apt, to make sure this happened one of them followed/chased him. They also ordered Jesse to go back into his apt. They didn't get the same result, what they got was he showed them he had a gun by pointing it up in the air. The response was simple one of the 2 men made a head fake and ran fast at Jesse making contact which resulted with a bullet being discharged. The second man who testified to consuming 7 beers,Vicodin, and marijuana (flailing to mention the vodka) charged and knocked Jesse to the ground had his two hands over the gun barrel while Jesse still had one hand on the handle. During this struggle a bullet was discharged and caused a non life threatening injury (no stitches) and released from hospital next day.
San Mateo County Gang Task Force responded to assist Foster City Police at the scene. The police did an excellent job in securing the scene.
What is questionable is the position our DA is taking.
He knows both men charged and attacked a man who was holding a gun in the air. After the man was piled on "All brutal like" and the gun was no longer a threat he was savagely beaten and kicked not only by one of the men but by at least one woman who broke her foot kicking him. Two of the witnesses did not want their names public and did not want to testify for fear of retaliation, they did finally testify one of them used the word gang and the DA had it stricken from the record. The other testified that a person was removed from the court for mumbling threats towards him while he was testifying. They have moved out of state and will not come back to testify.
The brother of one of the men is in prison for attacking an off-duty San Mateo County Sheriff Deputy in Burlingame. Our DA knows some of his witnesses have committed perjury in this case (Vodka) but it is more important for him to get a conviction.
Our DA's position is there is only one reason to bring out a gun and that is to kill. I disagree with that position, It should be one of the reasons but not the only one.
