Four days in county jail and three years of probation are ahead for Kwame Harris, the former San Francisco 49er offensive tackle and Palo Alto resident.
Mr. Harris, 31, was sentenced Friday morning (Dec. 20) in San Mateo County Superior Court in Redwood City after a jury in November convicted him of several misdemeanors related to an August 2012 assault of an ex-boyfriend at a Menlo Park restaurant.
Mr. Harris’ sentence specifies five days in jail, but he receives one day credit for time already served, District Attorney Steve Wagstaffe told the Almanac. He has been out of jail on $75,000 bail and is scheduled to surrender on Feb. 8. His first 18 months of probation will be supervised by a probation officer, Mr. Wagstaffe said.
Mr. Harris was accused of having assaulted Southern California resident Dimitri Geier, allegedly punching him “full force” in the face several times and leaving him with a broken eye socket that required surgery and a steel plate to repair, according to a civil complaint filed by Mr. Geier in October 2012.
The incident occurred at Su Hong To Go on Menlo Avenue. An argument began over a container of rice the two men planned to share before Mr. Harris drove Mr. Geier to the airport, the complaint says. Mr. Harris allegedly objected to Mr. Geier having poured soy sauce into the open lid of the rice container.
Mr. Harris allegedly grabbed Mr. Geier and punched him several times on the arms, the complaint says. In punching back, Mr. Geier allegedly landed several blows on Mr. Harris’ face, and Mr. Harris allegedly responded in kind.
The jury acquitted Mr. Harris of two felonies, but found him guilty of misdemeanor domestic violence, misdemeanor battery and two counts of misdemeanor assault.
In his sentence, Judge Joseph Scott also requires Mr. Harris to pay $910 in fines and undergo 104 hours of training to prevent domestic violence, Mr. Wagstaffe said, adding that Mr. Geier did not ask for restitution.
