District Attorney Steve Wagstaffe "That's made up."

This is his official response to reports from SamTrans Whistleblower victims that they were told by Kevin Raffaelli that his office did not have the funds to investigate $millions in public funds fraud. So now he is calling the victims liars, this is on top of Mark Simon and Mike Scanlon describing them as disgruntled ex-employees and delusional. Mr. Wagstaffe says he is conducting an inquiry now NOT an investigation.

What do the Supervisors of San Mateo County think of his behavior? Is this honest?

Honest? No. Typical? Yes.

Wagstaffe is just providing political cover. Don't expect the board to do a damn thing about it.

Did the whistleblowers record their conversation with Raffaelli ? Or, I thought I read that Raffaelli recorded the meeting. If so, we would find out who is making stuff up very quickly.

If the whistleblowers have recorded evidence of Raffaelli saying they had no money to pursue the case , then the whistleblowers should report Wagstaffe's comment to the California Bar. Basically, he's calling them liars.

I asked one of the whistleblowers this morning if he/she would be willing to make that statement under oath. The answer came back.....YES

I thought you wrote a comment somewhere, or maybe it was in the NBC story- that Raffaelli recorded their entire meeting.

That is correct, there was a meeting in the DA's office with two former SamTrans employees lasted less than an hour was recorded by Kevin Raffaelli.

The ""NO Funds" statement happened on a phone call from Raffaelli to one of the whistleblowers at a later date. We are not discussing discussing a recording of that call because of laws. Now the good news and NBC 11 reported it today is Wagstaffe is on this case and waiting for the audit which is being conducted now. So now the question is what about the Service League of San Mateo County conflict of interest between CEO Mike Scanlon and Steve Wagstaffe.

This inquiry/investigation should be referred out of County.

Hideous. Is Rafaelli trustworthy? I know little about him, just that various relatives of his have worked for the County in LEO positions & ADA, I think.

Excerpt:


Wagstaffe said Sadek's ex-wife was "absolutely, unequivocally" told the district attorney's office planned to drop the case, adding that he was in his office down the hall from prosecutor Melissa McKowan when she informed the woman of the decision.

"I don't know what Ms. Salarno's talking about there," Wagstaffe said.

Wagstaffe's MO is to always say the other person is lying. He actually told a citizen in his office a few years ago that he had - and this is a direct quote "never lied in his 35 years of office."

what Wagstaffe meant to say was he had "never lied in his 35 years in office. At least any that could be proven."

If anyone else knows of other instances where Mr. Wagstaffe has made false statements to the press, we would love to see them listed here.

One reporter who used to cover Wagstaffe six years ago told us that he used to routinely catch Wagstaffe making up stuff about cases... and it was always to make himself look better. The reporter said that even Wagstaffe's prosecutors said he made stuff up.

Our concern is that Wagstaffe did so at the expense of both criminal defendants AND crime victims.

Victim's advocate Michael Stogner has just learned that Ling La, a Whistleblower and former SamTrans accountant has filed a suit in Federal Court this last Wednesday naming as defendants CEO Michael Scanlon, Sheila Tioyao.

This suit is in addition to the criminal complaint filed with San Mateo County District Attorney Steve Wagstaffe 11 months ago. You will recall she was told that the DA's Office didn't have the funds to investigate this type of complicated crime. ( And then Wagstaffe told the press that this was "made up.") You would think this to be a newsworthy story for San Mateo County. Has any of the press besides NBC tried to find out what is going on with the DA's supposed investigation into this alleged fraud?

It's clear it's not going away.

Mr. Stogner:

Do you know why the whistleblowers filed a lawsuit in federal court? Is it because they were tired of waiting for the DA's office to do something? Do you have the case number?

Has the DA's office been in touch with the whistleblowers since Wagstaffe told the press six months ago he was doing an "inquiry?"
